From the immersive worlds of online gaming and the metaverse to the everyday platforms of social media and remote work, our digital lives are as real and meaningful as our physical ones. But as our presence in these virtual spaces grows, so too do the forms of harm we can experience within them. Virtual harassment, once a problem largely dismissed as a consequence of online anonymity, has evolved into a serious and pervasive threat that is causing real-world psychological and financial harm.

This escalating crisis has triggered a new legal frontier, where courts are being forced to grapple with a fundamental question: how do we apply laws designed for the physical world to a new reality where a perpetrator and their victim can be thousands of miles apart, and the weapon is a line of code or a hateful message? The old legal frameworks are struggling to keep up with the speed and complexity of the digital world, but a new legal reckoning is underway. The lawsuits are no longer just about online bullying; they are about virtual assault, digital stalking, and corporate accountability for the harms that are amplified on their platforms. Defining Virtual Harassment

  • Virtual Assault and Sexual Harassment: With the rise of the metaverse and virtual reality (VR), a new and insidious form of harassment is emerging. A user’s avatar can be virtually assaulted or sexually harassed, an experience that can feel remarkably real and traumatic to the user, even if there is no physical contact. This is creating a legal and ethical dilemma over how to apply laws like assault and battery to a virtual reality environment.
  • Targeted Misinformation and Defamation: Perpetrators can use online platforms to spread false and defamatory information about a victim, a form of harassment that can destroy a person’s reputation and career. This can include creating fake news articles or manipulating images to spread a false narrative.
